| 1. | The self-contained accommodation gives rise to a cramped studio layout arrangement which fails to include a separate sleeping area, adequate aspect and outlook or private amenity space, resulting in a poor quality living environment for the current or future occupants, contrary to Policies DC4 and DC61 of the LDF Core Strategy and Development Control Policies DPD and Policy 3.5 of the London Plan. |
| 2. | The shared communal nature of key elements of the layout; namely the rear garden of the bungalow and the garage section of the outbuilding, results in a stark lack of privacy for the occupants of both the outbuilding and the bungalow. The close proximity of the windows in both dwellings and the communal garden would result in a very strong perception of overlooking and would not enable the intended occupants to undertake day to day activities in private. The poor arrangement contributes to the overall lack of consideration for the amenity of the occupants of both dwellings and as such would be prejudicial to living conditions within the outbuilding and the bungalow. The change of use is therefore contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and the Residential Design SPD. |
| 3. | The change of use would, by reason of the inadequate on site car parking provision, be likely to result in unacceptable parking overspill onto the adjoining roads to the detriment of highway safety and residential amenity contrary to Policy DC33 of the Local Development Framework Core Strategy and Development Control Policies DPD. |
| 4. | In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan. |
| 5. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reasons for it was given to the agent John newton of John Newton Associates via email on 8/6/16. |
| 6. | The Local Planning Authority advise that the internal layout of the bedsit does not comply with drawing number 3261367/01 granted under planning application reference P0103.02 (condition 2) dated 19 March 2002. This breach will be the subject of a further enforcement investigation to ensure that this condition has been fully discharged and the layout accords with the approved plan. The continued use of the bedsit as a separate dwelling will also be monitored and formal action will be taken to ensure this use does not continue and become lawful with the passage of time. |
