| 1. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).

For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 2. | Unless within three months of the date of this decision, works to alter the wooden canopy, as shown on drawing nos. ZAAVIA/47URR/104 Rev B; 108 Rev A and 109 Rev A, which involve reducing the depth of the canopy to 4 metres on the boundary with no. 45 Upper Rainham Road with any additional depth set in at an angle of 45 degrees from the shared boundary, have been carried out, the canopy structure hereby permitted shall be removed in its entirety from the site and all materials arising therefrom shall be removed. |
| 3. | The roof area of the extension hereby permitted shall not be used as a balcony, roof garden or similar amenity area without the grant of further specific permission from the Local Planning Authority.
Reason:-
In the interests of the amenity of the occupiers of neighbouring dwelling, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61. |
| 4. | The canopy hereby approved shall remain as an open sided structure at all times and shall not be enclosed to the sides or rear.
Reason:
To accord with the terms of the application and to ensure any further impacts on neighbouring amenity can be controlled. |
| 5. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework 2018, improvements required to make the proposal acceptable were negotiated with ZAAVIA DESIGN LTD via telephone and email on 21 July 2021. The revisions involved revising the design of the proposal to comply with Council guidelines. The amendments were subsequently submitted on 8 August 2021. |
| 6. | Notwithstanding the drawing hereby approved, this permission does not relate to the detached rear outbuilding, or alterations to the roof of the application building, including hip to gable conversion and installation of front rooflights and rear dormer, for which no formal planning permission or certificate of lawfulness has been obtained. |
