| 1. | The proposed development would, by reason of its irregular and cramped design, establish a property which lacks functionality and fails to ensure the provision of adequate internal space and external amenity space for the host dwelling. The overdeveloped and unsuitable site layout is exacerbated by the inadequate outlook provided. The bedroom fronting onto the access road is likely to result in unsuitable conditions for occupiers by way of noise, privacy and disturbance. This scheme would be detrimental to the living conditions and amenity of the property's future occupiers contrary to Policies DC55, DC61of the LDF Core Strategy and Development Control Policies DPD, the Residential Design SPD and Policy 7.4 of the London Plan. |
| 2. | The development would, by reason of the dwelling siting, height and proximity to the boundaries of the plot, give rise to a cramped appearance and overdevelopment of the site, which would be harmful to the gardenscene and character of the surrounding area contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and the Residential Extensions and Alterations SPD. |
| 3. | The proposed development would, in the absence of suitable access, servicing and parking provision, result in unacceptable overspill onto the adjoining roads to the detriment of highway safety and residential amenity and contrary to Policy DC33 the LDF Core Strategy and Development Control Policies DPD and Policy 6.13 of the London Plan. |
| 4. | The removal of the condition is unacceptable as insufficient information has been supplied to demonstrate compliance with section 50.1.2 of BS 9991:2015 Fire safety in the design, management and use of residential buildings. As such the proposal fails to put in place adequate measures to minimise the potential physical risks to future occupiers, including those arising as a result of fire and related hazards, in accordance with London Plan Policy 7.13 (Safety, security and resilience to emergency). The installation of a domestic sprinkler system into each of the three dwellings is therefore necessary to safeguard future occupiers in terms of fire risk. |
| 5. | The proposal, if granted planning permission on appeal, would be liable for the Mayor of London Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the CIL payable would be £840.00. Further details with regard to CIL are available from the Council's website. |
| 6. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to Robert Deasley via telephone on 25/07/18. |
