| 1. | The proposed development would, by reason of its site coverage, quantum of development, building typology, layout, scale and bulk, result in a cramped and incongruous form of development, be out of character with the prevailing pattern of development in the surrounding area to the detriment of the visual amenity of the locality contrary to the high quality design aspirations of the National Planning Policy Framework (2021), policies D1, D3 and D4 of The London Plan (2021), London Plan Housing SPG and policies 3, 7 and 26 of the Havering Local Plan; and the Havering Residential Design SPD. |
| 2. | The proposed development would due to the constraints of the site in conjunction with the site coverage and the design approach result in habitable rooms having inadequate outlook and poor aspect, as well as the development providing insufficient communal amenity space, which would give rise to substandard levels of residential accommodation to the detriment of the amenity of the prospective occupiers, in direct contrast to the aims of London Plan Policies D4 and D6 and Havering Local Plan Policies 7 and 26. |
| 3. | The proposed development would due to the constraints of the site, the extent of site coverage and the design approach result in a significant loss of light, outlook, overlooking and an increased sense of enclosure to the detriment of the amenity of the neighbouring occupiers, contrary to the aims of Havering Local Plan Policies 7 and 26. |
| 4. | The proposed development fails to provide an appropriate mix of units including a significant proportion of three bed or more family housing to address the identified needs within the borough contrary to the aims of Policy 5 of the Havering Local Plan. |
| 5. | Notwithstanding the viability position in respect to the development, the proposal fails to provide any provision of affordable housing to address the borough's identified need for such housing contrary to Policy H4, H5 & H6 of the London Plan and Policy 4 of the Local Plan. |
| 6. | Insufficient information has been submitted with regard to justification for the number of car spaces proposed, as well as whether the appropriate amount of cycle spaces can be accommodated within the scheme which could be detrimental to highway impacts of other road users and pedestrians on the surrounding highways network contrary to London Plan Policies T4, T5, T6.1 and T7, Policy 24 of the Havering Local Plan and the London Cycle Design Standards (LCDS). |
| 7. | In the absence of a legal agreement to secure contributions towards carbon reduction, employment skills and training, apprenticeship, residential travel plan, restriction on ability to obtain parking permits and the provision of public realm/open space/highways improvements, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, the proposal would be contrary to the provisions of Policies 16, 22, 24 and 36 of the Havering Local Plan 2016 - 2031, Policy DF1 of the London Plan. |
| 8. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal was given to the agent. |
| 9. | The proposal, if granted planning permission on appeal, would be liable for the Mayor of London and Havering Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the Mayoral CIL payable would be £383,850 based on the calculation of £25.00 per square metre and the Havering Community Infrastructure Levy (HCIL) would be a charge of £1,919,250 based on calculation of £125 per square metre. Each would be subject to indexation.
