1.The proposed side dormers to the proposed bedrooms would, by reason of their height, positioning and proximity to the south-western boundary cause an unacceptable degree of overlooking towards No. 3 Ayloffs Close reducing their privacy and thereby causing material harm to their amenity contrary to Policy 7 of the Local Plan and the Council's Residential Extensions and Alterations SPD.
2.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with the agent via email on 24/04/2024. The revisions involved a re-design of the the dwelling to prevent overlooking from the side facing dormers. The applicant declined to make the suggested revisions.
3.The proposal, if granted planning permission on appeal, would be liable for the Mayor of London and Havering Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the Mayoral CIL payable would be £3,625 based on the calculation of £25.00 per square metre and the Havering Community Infrastructure Levy (HCIL) would be a charge of £18,235 based on calculation of £125 per square metre.
