1.The proposed development due to its bulk, scale, massing and in particular with respect to its proximity to the boundaries of the adjoining properties, would result in a cramped form of development, contrary to the established pattern of development of the area, detrimental to the character and appearance of the Emerson Park Policy Area, contrary to policies 7 (design and amenity), 10 (Garden and backland development), 26 (Urban design), 27 (Landscaping) and 28 (Heritage) of the Local Plan 2021 and policies D3 of the London Plan 2021 and the advice given in part 12 of the National Planning Policy Framework 2021.
2.The proposed development by reason of scale, bulk, massing and proximity to adjoining boundaries, plus the loss of significant degree of greenery along the boundaries with the neighbouring properties would result in an overbearing impact upon the amenities of the occupiers of the neighbouring dwellings, as well as a significant adverse impact on the adjoining residents enjoyment of their rear gardens. As such, the proposed development is contrary to Policies 7 and 10 of the Local Plan 2021 and paragraph 130 of the Framework which seeks to ensure all developments creates places with a high standard of amenity for existing and future user.
3.For Residential Development Only Please be advised that approval of this application from 1st September 2019 (either by London Borough of Havering, or subsequently by PINS if allowed on appeal following a refusal by London Borough of Havering) will attract a liability payment of £79,350 plus indexation in Community Infrastructure Levy (CIL). This charge has been levied under s.206 of the Planning Act 2008 and includes both the Mayor of London's CIL and Havering Council's CIL. London Borough of Havering, as CIL collecting authority, has responsibility for the collection of the Mayoral CIL, in addition to Havering's CIL, on commencement of the development.
