1.This permission shall be for a limited period only expiring on 2nd August 2017 on or before which date the use hereby permitted shall be discontinued, the works carried out under this permission removed and the site reinstated to its former condition to the satisfaction of the Local Planning Authority. Reason: To enable the Local Planning Authority to retain control.
2.The external seating area shall not be used later than 22:00 on Sunday to Thursday and 23:00 on Friday and Saturday. Reason: To prevent noise nuisance to adjoining properties.
3.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
4.No amplified music or speech shall be played or reproduced in the external seating area hereby approved at any time. Reason: To prevent noise nuisance to adjoining properties.
5.The seating within the external seating area hereby approved shall be removed from the pavement between the hours of 22:00 and 10:00 (the following morning) on Sunday to Thursday and 23:00 and 10:00 (the following morning) on Friday and Saturday. Reason: To prevent noise nuisance to adjoining properties.
6.The Applicant is advised that this decision grants planning consent only. Separate consent will need to be obtained under the Highways Act and Licensing. 7.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with para 186-187 of the National Planning Policy Framework 2012, improvements required to make the proposal acceptable were negotiated during a telephone conversation with Mr Alam on 1st August 2016. The revisions involved restricting the use of the external seating area to 22:00 on Sunday to Thursday and 23:00 on Friday and Saturday.
