| 1. | The proposed takeaway use would fail to maintain a minimum of 3 units in alternative use between Sui Generis takeaway uses and would further increase the proportion of Sui Generis takeaway uses greater than 10% within the primary frontage; and the proposed change to Class E(b) would further reduce the proportion of primary frontage in E(a), E(c)(i) and E(c)(ii) uses to less than 60%. As such the proposals fail to comply with Local Plan policy 13. |
| 2. | In the absence of detailed specification for the provision of a fume extraction system or details to demonstrate satisfactory mitigation measures for the emission of cooking odours and fumes from the premises, the proposal by virtue of its proximity to residential flats, would have an unacceptable impact on the residential amenity due to increased levels of noise and vibration and odours associated with the kitchen facilities ancillary to the operation of a fast food takeaway contrary to Having Local Plan policies 13 and 34 and London Plan (2021) policy D14. |
