| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:
The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. | 3. | The premises shall not be used for the purposes hereby permitted other than between the following hours:
Monday to Thursday 12:00 to 22:30
Friday and Saturday 12:00 to 23:30
Sundays 12:00 to 22:00
Good Friday and Christmas Eve 12:00 to 00:00
New Year's Eve/Day 12:00 to 00:30
With all activity to cease 20 minutes after closing.
without the prior consent in writing of the Local Planning Authority.

To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 4. | Before the development hereby permitted commences details of a scheme shall be submitted to and approved in writing by the local planning authority which specifies the provisions to be made for the control of noise emanating from the premises. Such scheme as may be approved shall be implemented prior to first occupation and thereafter retained in accordance with such details.
Reason: To prevent noise nuisance to adjoining/adjacent properties in accordance with Development Control Policies Development Plan Document Policy DC55 and DC61 |
| 5. | Before any works commence a scheme for any new plant or machinery shall be submitted to the local planning authority to achieve the following standard. Noise levels expressed as the equivalent continuous sound level LAeq (1 hour) when calculated at the boundary with the nearest noise sensitive premises shall not exceed LA90 -10dB and shall be maintained thereafter to the satisfaction of the Local Planning Authority.

| 6. | All deliveries and refuse collections shall not occur between 8pm and 7am and there shall be no deliveries and rubbish collections on Sundays or Bank Holidays.
Reason: To preserve and maintain the amenities of occupiers of neighbouring residential properties, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61 |
| 7. | There shall be no outdoor seating in any area surrounding the site including either in the forecourt or the rear of the premises without the prior written permission of the Local Planning Authority obtained through the submission of a planning application.
Reason: To ensure that the residential amenities of occupiers of neighbouring residential properties are safeguarded, in accordance with Development Control Policies Development Plan Document Policy DC55 and DC61 |
| 8. | No amplified music shall be played at the premises in connection with the use of the premises as a drinking establishment

| 9. | Notwithstanding the provisions of the Town and Country Planning Use Classes Order 1987 (or any order revoking and re-enacting that Order with or without modification) the premises shall only be used as a micropub and not for any other purpose, including any other use within Use Class A4 of the above Order, without the prior written permission of the Local Planning Authority obtained through the submission of a planning application.
Reason: To enable the local planning authority to maintain strict control over the nature of the use in order to restrict the use of the premises to one compatible with the surrounding area, in accordance with policies |
| 10. | The main shop front of the building shall be clearly visible from 9am-5pm Monday to Saturday and from 11am to 3pm on Sundays and not obscured by security shutters during these times.
Reason: In order to maintain an active frontage to the premises and prevent harm to the streetscene in in accordance with Development Control Policies Development Plan Document Policy DC61 |
| 11. | This permission is for change of use only, and therefore no alterations to the shop front or design for advertising purposes or signage may be undertaken as part of this permission. Any such alterations proposed requiring permission should be submitted separately.

| 12. | Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework 2019. |
| 13. | No domestic waste collections will apply to this proposal. The business will require a suitable waste contract to meet the requirements of the business. Commercial waste will require suitable storage arrangements. |
