1.The proposed development would, by reason of its positioning close to the side boundary with no.1 Silvermere Avenue appear as a dominant and visually intrusive development, which would unduly enclose the street scene at this prominent location and would also give rise to a form of development which is at odds with the prevailing character of development in the locality, thereby materially harmful to the character and appearance of the surrounding area, contrary to Policy 7 and 26 of the Havering Local Plan.
2.The proposal would provide inadequate parking for the new dwellings leading to an increased demand for on-street parking in the area to the detriment of the safety and functioning of the highway contrary to Policy 24 and 26 of the Havering Local Plan and Policy T6 of the London Plan.
3.The proposed development would, by reason of its positioning, orientation and proximity to the nearby property at no.153 Clockhouse Lane, in particular the first floor habitable room, would allow overlooking of the rear garden of the adjoining property and result in an unreasonable loss of privacy to the occupiers; additionally, there would be potential loss of privacy to future occupiers of the new dwellings due to design, proximity and orientation in relation to the raised patio area of no.3 Silvermere Avenue contrary to Policy 7 of the Havering Local Plan and the Residential Extensions and Alterations Supplementary Planning Document.
4.Insufficient information has been provided to assess the impact on ecology and biodiversity on this site. In the absence of such information it is considered that the proposal may have a significant adverse impact upon the ecology and biodiversity of the site contrary to Policy 30 of the Havering Local Plan.
5.In the event that this application is allowed through the appeals process the proposals would be liable for the following CIL contributions: Mayoral CIL (MCIL2) contribution of £5945 (x £25 per sqm). Havering CIL (HCIL) contribution of £29,725 (x £125 per sqm). Each contribution would be subject to indexation.
6.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, it was necessary to issue a decision as close to the statutory timeframe as possible as opposed to seeking amendments which would have significantly delayed the application.
