1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The scheme shall be implemented strictly in accordance to the revised drawings here by approved and the works shall be executed as follows; The existing internal access between the main property and the additional accommodation to be retained to ensure that the annexe remains a part of the host. - The brick and mortar used for the infill below the new window should be to match the adjacent fabric and utilise a straight joint rather than disturb the existing fabric. - The new entrance and fenestration shall be positioned within the existing reveals and recessed. Reason:- In order to ensure the character and appearance of the Listed Building and the special interest of the heritage asset is safeguarded and that the proposed development to accords with Development Control Policies Development Plan Document Policy DC67.
3.The annex hereby permitted shall be used only for living accommodation as an integral part of the existing dwelling known as Capel Nelmes, 1 Sylvan Avenue and shall not be used as a separate unit of residential accommodation at any time. Reason:- The site is within an area where the Local Planning Authority consider that the sub-division of existing properties should not be permitted in the interests of amenity and preserving the historic integrity of the building, and that the development accords with Development Control Policies Development Plan Document Policy DC61 and DC67.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework 2018, improvements required to make the proposal acceptable were negotiated with the applicant and a volunteered architect to provide accurate and large scale drawings depicting the detailed proposed alteration. The amendments were subsequently submitted on 15.06.2020.
