1.The area set aside for car parking, approved as part of planning permission P2003.00, shall be permanently retained for the accommodation of vehicles visiting the site and shall not be used for any other purpose, except during the month of August on an ongoing basis hereafter. Reason:- To ensure that car parking accommodation is made permanently available to the standards adopted by the Local Planning Authority in the interest of highway safety, and that the development accords with the Policy DC32 of the Core Strategy and Development Control Policies DPD.
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, particulars and specifications. Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted.
3.The scheme, approved as part of planning permission P2003.00, to restrict the use of the car park to users of Roomes Stores in Upminster Town Centre, shall continue to be adhered to. The car park shall be operated in accordance with the approved details and restricted to store opening hours only unless otherwise agreed in writing. Reason - To protect the amenity of neighbouring residents from vehicle noise, particularly late in the evening, in accordance with Policy DC61 of the Core Strategy and Development Control Policies DPD.
4.Goods deliveries to the store shall not take place other than between the hours of 07:30 and 20:00 Mondays to Fridays, 07:30 and 18:00 Saturdays and not at all on Sundays, Bank or Public Holidays without the prior consent in writing of the Local Planning Authority. Reason - To enable the Local Planning Authority to retain control in the interests of amenity, in accordance with Policy DC61 of the Core Strategy and Development Control Policies DPD.
5.The existing disabled car parking spaces, required by planning permission P2003.00, shall be retained at all times. Reason - To ensure that car parking accommodation for people with disabilities is made available to the standards adopted by the Local Planning Authority.
6.Unless otherwise agreed in writing by the Local Planning Authority, all deliveries from manufacturers or distributors shall be made to the applicants premises at 51 - 53 Station Road, or other remote warehouse facilities within the applicants control, for subsequent delivery of stock to the store the subject of this planning permission, using vehicles of a size and description as agreed under condition 8. Reason - In the interests of highway safety and to prevent obstruction of the highway by reversing vehicles.
7.Deliveries to the store shall only take place from the associated car park in St Lawrence Road, and shall only be made by private light goods vehicles of a weight no greater than 7.5 tonnes, unless otherwise agreed in writing by the Local Planning Authority. Reason - In the interests of highway safety and to ensure that all vehicles making deliveries are capable of entering and exiting the store site in forward gear.
8.No development shall commence until a travel plan has been submitted to and agreed in writing by the Local Planning Authority. The plan shall include measures to reduce private vehicular trips and shall remain permanently thereafter to the satisfaction of the Local Planning Authority. The measures detailed in the Travel Plan, approved as part of planning permission P2003.05, shall continue to be adhered to. Reason: In the interest of highway safety and residential amenity, in accordance with Policy DC32 of the Core Strategy and Development Control Policies DPD.
9.The proposed marquee shall not exceed 5.5m in height. Reason:- In the interests of visual and residential amenity and in accordance with Policy DC61 of the Core Strategy and Development Control Policies DPD.
10.No plant or machinery shall be used at the site, including generators, until details have been submitted to and approved in writing by the Local Planning Authority. The equipment shall then be installed on site and maintained thereafter in accordance with the approved details. Reason: In the interests of residential amenity and to accord with Policies DC55 and DC61 of the Core Strategy and Development Control Policies DPD.
11.Reason for Approval The proposed development is considered to be in accordance with the aims, objectives and provisions of Policies DC32 and DC61 of the LDF Core Strategy and Development Control Policies Development Plan Document. Note: Following a change in government legislation a fee is now required when submitting details pursuant to the discharge of conditions, in order to comply with the Town and Country Planning (Fees for Applications and Deemed Applications) (Amendment) (England) Regulations, which came into force from 06.04.2008. A fee of £97 per request (or £28 where the related permission was for extending or altering a dwellinghouse) is needed.
12.Statement Required by Article 31 (cc) of the Town and Country Planning (Development Management) Order 2010: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012.
