| 1. | The proposed first floor side extension to the dwelling's west elevation, by virtue of it position approximately 1m away from the shared property boundary with No.6 Peerage Way, would fail to meet the minimum requirement for first floor extensions to be set away from property boundaries by at least 2m, as set out in the Emerson Park Policy Area Supplementary Planning Document (2009). As a result, the proposed development would be detrimental to the character and appearance of the wider area, contrary to the provisions of Emerson Park Policy Area SPD and Policy 26 of the Havering Local Plan (adopted 2021). |
| 2. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy a decision was made on the application, which will enable the applicant to exercise a right of appeal if they so wish. |
| 3. | The proposal, if granted planning permission on appeal, would be liable for the Mayor of London and Havering Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the Mayoral CIL payable would be £5,614.25 based on the calculation of £25.00 per square metre and the Havering Community Infrastructure Levy (HCIL) would be a charge of £28,071.25 based on calculation of £125 per square metre. Each would be subject to indexation.
