1.The development to which this permission relates must be commenced not later than five years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990.
2.Before any of the buildings hereby permitted is first occupied, the area set aside for car parking shall be laid out and surfaced to the satisfaction of the Local Planning Authority and retained permanently thereafter for the accommodation of vehicles visiting the site and shall not be used for any other purpose. Reason:- To ensure that car parking accommodation is made permanently available to the standards adopted by the Local Planning Authority and to prevent the obstruction of nearby streets by parked vehicles.
3.Before any of the buildings hereby permitted is first occupied, a properly hardened area shall be provided within the curtilage of the site and thereafter retained for the loading, unloading and turning of vehicles to the satisfaction of and in accordance with details to be approved by the Local Planning Authority, and no loading or unloading of goods (including fuel) from vehicles arriving at or departing from the premises shall be carried out otherwise than within such area. Reason:- To avoid obstruction of the surrounding streets and to safeguard the amenities of occupiers of the neighbouring property.
4.All new external finishes shall be carried out in materials to match those of the existing buildings and samples of the materials used shall be submitted to and agreed in writing by the Local Planning Authority prior to the commencement of any of the works hereby permitted. Reason:- To safeguard the appearance of the premises and the character of the immediate area.
5.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, particulars and specifications. Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted.
6.There shall be no external storage of goods of whatever nature, for display, sale or anyother purpose whatsoever, nor any stationing of skips or other waste disposal receptacles on the designated car-parking spaces as shown on approved plan No.MDC62/01. Reason:- In the interests of visual amenity and to ensure adequate car parking and loading/unloading and manoeuvring space for vehicles servicing the site.
7.In view of the fact that the site is located on a former tip, the applicant or developer is required to determine if methane gas is present in the ground and, if so, to undertake such measures as may be required to avoid the possibility of the gas entering the building hereby permitted. Schemes for testing the methane gas and any subsequent works required to deal with any gas found to be present are to be submitted to the Local Planning Authority, must be agreed in writing prior to the commencement of the works hereby permitted and must have been satisfactorily implemented prior to the building first being occupied. In addition, the building shall be fitted with methane gas monitoring equipment prior to the building first being occupied, in accordance with details which shall previously have been submitted to and agreed in writing by the Local Planning Authority. Reason:- To ensure the safety of occupants of the development and the public generally.
