1.The development to which this permission relates must be commenced not later than five years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990.
2.Before any of the buildings hereby permitted are first occupied, the area set aside for car parking shall be laid out, surfaced and annotated for use by occupiers to the satisfaction of the Local Planning Authority and retained permanently thereafter for the accommodation of vehicles visiting the site and shall not be used for any other purpose. Reason- To ensure that car parking accommodation is made permanently available to the standards adopted by the Local Planning Authority and to prevent the obstruction of nearby streets by parked vehicles.
3.Before the development hereby permitted is commenced, samples of all the materials to be used in the external construction of the buildings and all hardsurfacing of the site, shall be submitted to and approved in writing by the Local Planning Authority. Reason- The site is located within a shopping area where it is important to ensure the provision of retail facilities to the local community.
4.Before any of the development hereby permitted is commenced, a scheme of landscaping shall be submitted to and approved by the Local Planning Authority. Such scheme shall be undertaken in the first available planting season after completion of the development and any trees or shrubs dying within five years of planting shall be replaced. Reason:- In accordance with Section 197 of the Town and Country Planning Act 1990 and to enhance the visual amenities of the development.
5.Before any of the buildings hereby permitted is first occupied, screen fencing of a type to be approved in writing by the Local Planning Authority, 2 metres (6ft. 7ins.) high shall be erected where shown by a blue line on the approved plan and shall be permanently retained thereafter. Reason:- To protect the visual amenities of the development and prevent undue overlooking of adjoining property.
6.Before any of the buildings hereby permitted is first occupied screen walling of a type to be approved in writing by the Local Planning Authority 2 metres (6ft. 7ins.) high shall be erected where shown by a green line on the approved plan. Reason:- To protect the visual amenities of the development and prevent undue overlooking of the adjoining property.
7.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, particulars and specifications. Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted.
8.The proposed windows marked 'A' on the approved plans shall be permanently glazed with obscure glass to the satisfaction of the Local Planning Authority. Reason:- In the interests of privacy.
9.That the retail units shown on the plans hereby permitted shall be constructed to shell stage in accordance with details and specifications which shall previously have been submitted to the Local Planning Authority prior to the occupation of any of the residential units hereby approved. Reason- The site is located within a shopping area where it is important to ensure the provision of retail facilities to the local community.
10.On completion of the development hereby permitted, the first use of the accommodation shall be solely by a Housing Association registered with the Housing Corporation for occupation by its own tenants. Reason- To ensure that the accommodation is first used to meet a housing need, and in view of the particular nature of the development proposals.
11.That before the development hereby approved is first commenced, details of both balcony screening and external staircase arrangements shall be submitted to and approved in writing by the Local Planning Authority. Reason- No details of these arrangements accompanied the application.
12.Before the development hereby permitted is commenced, details of the proposed oriel windows identified on the submitted drawings as relating to units M, T, A2 and B2 shall be submitted to and approved in writing by the Local Planning Authority. The agreed scheme shall thereafter be retained. Reason- To ensure the potential for overlooking of adjoining residential property is minimised in the interests of residential amenity.
13.That a service layby shall be provided in the position shown by cross hatching on the submitted drawings in accordance with details which shall previously have been submitted to and approved in writing by the Local Planning Authority. Therafter the service layby shall be retained in perpetuity. Reason- In order to ensure satisfactory service provision is available at all times for the retail units hereby approved and to avoid servicing of the shops from the street which could impede the safe and free flow of traffic.
14.ADDITIONAL CONDITIONS IN RESPECT OF RETAIL UNIT NO. 1: The premises shall be used only for the purposes of a take-away hot food shop only and for no other purpose including specifically, that of a restaurant within Class A3. Reason- In view of the limited parking facilities available on site.
15.The premises shall not be used for the purposes hereby permitted before 08.30 hours nor after 23.00 hours Mondays to Saturdays and 08.30 hours and 22.30 hours on Sundays. Reason- In the interests of amenity.
16.Before the use commences, suitable equipment to remove and/or disperse odours and odorous material shall be fitted to the extract ventilation system in accordance with a scheme to be approved in writing by the Local Planning Authority. Thereafter, the equipment shall be properly maintained and operated during normal working hours. Reason- To protect the amenity of occupiers of nearby premises.
17.Before the use commences, a scheme to control the transmission of noise and vibration from any mechanical ventilation system installed shall be submitted to and approved in writing by the Local Planning Authority and implemented prior to the permitted use commencing. Reason- To protect the amenity of occupiers of nearby premises
18.Before the use commences, a waste management scheme shall be submitted to and approved in writing by, the Local Planning Authority. The scheme, which shall thereafter be permanently maintained shall include details of the method and location of refuse storage, together with arrangements for refuse disposal. All refuse shall be properly stored or deposited elsewhere unless previously agreed in writing by the Local Planning Authority. Reason- To protect the amenity of occupiers of nearby premises.
