1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The premises shall not be used for the purposes hereby permitted other than between 11:00 and 22:00 Monday to Saturday and 12:00 and 22:00 on Sundays, Bank and Public Holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
4.A window display shall be provided at all times in the window(s) fronting New Road. Reason:- In the interests of visual amenity.
5.No refuse collection shall be carried out from the site outside the following times - 07:00 to 19:00 hours Monday to Friday, and 08:00-13:00 hours on Saturday nor at time on Sundays, Bank or Public Holidays. Reason:- In order to protect the amenity of the area.
6.Before the use commences suitable equipment as detailed in the accompanying ventilation statement and associated specification detail provided to support this application shall be implemented, as a minimum, before the hereby permitted use commences. The approved equipment shall be installed on site and certification provided by a competent engineer. Thereafter, the equipment shall be properly maintained and operated within design specifications during normal working hours. Reason:- To prevent a loss of amenity to neighbouring (residential) properties from odour and odorous materials.
7.The scheme to control noise and vibration, as detailed in the noise report provided by DAA Group (dated 4/7/2023) submitted with this application shall be implemented, as a minimum, before the hereby permitted use commences. Such a scheme as approved shall be implemented prior to first occupation and thereafter retained and maintained in accordance with such details, and should comply with the following requirement at all times: The Specific Noise Level emitted from the hereby permitted plant or machinery shall not exceed 10dB below the prevailing background noise level (LA90, T). Additionally, the Rating Sound Level shall not exceed 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound."¯ The use hereby permitted must cease during any period that this condition is not complied with. Reason:- To protect the amenity of noise sensitive premises from noise from mechanical plant
8.Before the commercial use commences, that part of the building shall be insulated in accordance with a scheme which shall previously have been approved by the Local Planning Authority in order to secure a reduction in the level of noise emanating from it and it shall be effectively sealed to prevent the passage of odours through the structure of the building to other premises and dwellings. Reason:- To prevent a loss of amenity to neighbouring (residential) properties from noise and odour.
9.No deliveries shall be taken at from the site outside the hours of 07:00-19:00 Monday - Friday and 08:00-13:00 hours on Saturday unless agreed in writing with the Local Planning Authority. No deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the Local Planning Authority. Reason:- In order to protect the amenity of the area.
10.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.

13.The applicant is advised and encouraged to meet the requirements of The Healthier Catering Commitment (HCC).
