1.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
2.The proposed development hereby approved shall be constructed in accordance with the materials detailed on the plans and the application form unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the appearance of the proposed development will harmonise with the character of the surrounding area.
3.The playground equipment hereby permitted shall not be used by the wider community and shall be solely restricted for use by St Mary's Roman Catholic Church School and shall not be used for any other use. Reason:- In order to control the development and to protect the amenities of the locality and to ensure there are no unacceptable environmental, safety or traffic problems in accordance with Policy 7 and 26 of the Havering Local Plan.
4.No new artificial lighting shall be installed within or around the playground equipment hereby permitted. Reason:- In order to protect the amenities of the locality in accordance with Policy 7 and 26 of the Havering Local Plan.
5.The use of the development hereby permitted, shall be limited to school hours between the hours of 08:30 to 15.30 on Mondays to Fridays and shall not be used on Saturdays, Sundays and Bank Holidays. Reason:- In order to protect the amenities of the locality in accordance with Policy 7 and 26 of the Havering Local Plan.
6.Within two months of the date of this approval, the 2.5m high screen fencing shown on the plans along the boundaries to the rear of the adjoining houses at Albany Road should be erected and be permanently retained and maintained thereafter. Reason:- To prevent undue overlooking and loss of privacy of the adjoining properties in accordance with Policy 7 and 26 of the Havering Local Plan.
7.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with Jo Hatley via email on 6.9.23. The revisions involved a 2.5m high screen fence along the site boundary with the rear gardens of adjoining houses at Albany Road. The amendments were subsequently submitted on 21.9.23.
