1.This permission shall be for a limited period only expiring on 10th August 2019 on or before which date the Portakabin building and works carried out under this permission shall be removed and the site reinstated to its former condition to the satisfaction of the Local Planning Authority. Reason:- To protect the amenities and character of the area in accordance with Policy DC61 of the Development Control Policies Development Plan Document.
2.The Portakabin building hereby permitted shall be removed and all materials resulting from the demolition shall be removed within 3 months of the date of failure to meet any one of the requirements set out in (i) to (iv) below:- i. within 28 days of the date of this decision a scheme for enhancing the external appearance of the Portakabin building shall have been submitted for the written approval of the local planning authority and the scheme shall include a timetable for its implementation. ii. if within 11 months of the date of this decision the local planning authority refuse to approve the scheme or fail to give a decision within the prescribed period, an appeal shall have been made to, and accepted as validly made by, the Secretary of State. iii. if an appeal is made in pursuance of (ii) above, that appeal shall have been finally determined and the submitted scheme shall have been approved by the Secretary of State. iv. the approved scheme shall have been carried out and completed in accordance with the approved timetable. Reason:- To ensure that the appearance of the proposed development will harmonise with the character of the surrounding area and comply with Policy DC61 of the Development Control Policies Development Plan Document.
3.The Portakabin building shall not be used for purposes hereby permitted other than between the hours of 08:00 to 20:00 on Monday to Friday, 09:00 to 17:00 on Saturday and not at all on Sunday, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
4.The area to the front and side of the Portakabin building, set aside for car parking, shall be retained permanently for the accommodation of vehicles visiting the site and shall not be used for any other purpose. Reason:- To ensure that car parking accommodation is made permanently available to the standards adopted by the Local Planning Authority in the interest of highway safety, and that the development accords with the Development Control Policies Development Plan Document Policy DC33.
5.Unless within 28 days of the date of this decision a method for obscuring the windows in the southern flank wall of the Portakabin, adjacent to the boundary with 4 Craigdale Road, is submitted in writing to the local planning authority for approval, and unless the approved scheme is implemented within 28 days of the local planning authority's approval, the use of the Portakabin building shall cease until such time as a scheme is approved and implemented. If no scheme in accordance with condition 5 is approved within 4 months of the date of this letter, the use of the site Portakabin building shall cease until such time as a scheme approved by the local planning authority is implemented. Reason:- In the interests of privacy, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61.
6.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012.
