| 1. | The proposed dwelling through its design, mass and site layout would form an isolated, incongruous and visually cramped form of development at odds with surrounding character and patterns of development in an environment more familiar with subordinate outbuildings and consistent plot sizes. The proposals would therefore be contrary to Policies 10, 7 and 26 of the Havering Local Plan 2016-2031 and also Paragraph 130(a) of the NPPF which requires fundamentally that development add to the overall quality of the area whilst also establishing or maintaining a strong sense of place. |
| 2. | Owing to the cramped nature of the development, poor outlook and arrangement of the development including outside amenity provision, officers do not consider that the proposals align with the objectives of Havering Local Plan 2016-2031 Policy 7 and the London Plan Policy D6 and as such would not demonstrate an adequate living environment for future occupants. There would be conflict with Para 130(f) of the Framework also which requires that development create spaces that are safe and provide a high standard of amenity for existing and future users. |
| 3. | The proposed dwelling would form a visually intrusive and overbearing feature from the rear garden of adjoining sites which would be detrimental to neighbouring amenity and would therefore be contrary to Policies 10, 7 and 26 of the Havering Local Plan 2016-2031. There would also be conflict with paragraph 130 of the National Planning Policy Framework which seeks to ensure a high standard of amenity for existing and future occupiers. |
| 4. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the agent in writing 19-09-2023. |
| 5. | In the event that this application is allowed through the appeals process the proposals would be liable for the following CIL contributions:
Mayoral CIL (MCIL2) contribution of £2,075 (x £25 per sqm).
Havering CIL (HCIL) contribution of £10,375 (x £125 per sqm)
Each contribution would be subject to indexation. |
