1.There shall be no restriction in the hours of operation for the leisure unit so long as the leisure unit is operated by "The Gym Ltd", in accordance to mitigating measures identified in the associated planning statement. The retail use hereby permitted shall not open to the public other than between 8.00 am to 9.00 pm on any day. Reason: In the interests of amenity.
2.The leisure unit hereby approved shall solely be used as a gymnasium, fitness and/or areobic facility and shall not be used for any other purpose including any other use falling within Class E(d) of the Town and Country Planning Use Classes Order 1987. Reason: To restrict the use having regard to the speculative nature of this part of the application in the interests of amenity and having regard to limited on site parking facilities.
3.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, particulars and specifications under P1024.98 Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted.
4.Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order 1995, no window or other opening (other than those shown on the submitted plan, a copy of which is attached), shall be formed in the flank wall(s) of the building(s) hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority. Reason:- In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future.
5.The development hereby permitted shall retain externally mounted ventilation and/or extract equipment approved under P1024.98 unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning. Reason: In the interests of amenity.
6.2.1 metre pedestrian visibility splays shall be permanently maintained as annotated on the approved plan. Reason: In the interests of highway safety.
7.No loading or unloading shall take place within the rear car park or service yard other than between the hours of 7.00 am to 10.00 pm on Mondays to Saturdays and 10.00 am to 4.00 pm on Sundays. Reason: In the interests of amenity.
8.Disabled parking facilities at a radio of 4% of overall parking provision shall be permanently retained within the development in full accordance with details to be agreed in writing with this Local Planning Authority before the use commences. Reason: To cater for the needs of disabled drivers.
9.Notwithstanding details on the approved plan, the cross hatched area annotated on the plan approved under P1024.98 shall be permanently reserved as a service vehicle manoeuvring area, and shall be permanently marked on site in accordance with details agreed in writing with this Local Planning Authority before the use commences. The marked area shall not be used for car parking. Reason: To ensure safe and efficient operation of the service area in the interests of highway safety and amenity.
10.Before the permitted use commences covered cycle facilities shall be permanently provided within the curtilage of the site in accordance with details previously agreed in writing with this Local Planning Authority. Reason: To encourage cycle borne use of the site.
11.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
