1.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
2.Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended), the use hereby permitted shall be for tyre shop for fitting & sales only and shall be used for no other purpose(s) whatsoever including any other use of the Order, unless otherwise agreed in writing by the Local Planning Authority. Reason:- To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application.
3.The premises shall not be used for the purposes hereby permitted other than between the hours of 09:00-18.00 hours Mondays to Fridays, between the hours of 09.00-13.00 hours on Saturdays and not at all on Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
4.The use as a tyre shop shall cease unless, within 3 months of the date of this decision, a scheme to control the transmission of noise and vibration from any mechanical plant and equipment (including tools) has been submitted to and approved in writing by the Local Planning Authority. Any scheme should meet the following standard: The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound." , and ; Unless the approved scheme is implemented within 2 months of the local planning authority's approval, the hereby permitted use shall cease until such a time the scheme is approved and implemented. The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with. Thereafter, the equipment shall be properly maintained and operated during normal working hours. Reason: To protect the amenity of noise sensitive premises from noise and vibration from mechanical plant
5.No deliveries or waste collections shall be taken at or despatched from the site outside the hours of 08.00-18:00 Monday - Friday and 09.00 to 13.00 hours on Saturdays unless agreed in writing with the Local Planning Authority. No deliveries or collections shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the Local Planning Authority. Reason: In order to protect amenity of the area
6.Waste & Recycling Informative The applicant is reminded that the business should put in place a suitable contract for the collection of commercial waste from the site.
7.Advertisement Consent Informative The applicant is advised that advertisements displayed at the site are not subject of this application and will require separate advertisement consent.
8.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with Mr Anwar (Agent) by phone and e-mail. The revisions involved revising plans due to duplicate plan numbers and multiple plans. Neighbours were not re-consulted as these changes were sought for clarity. The amendments were subsequently submitted on 02/12/25.
