| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the use hereby permitted shall be limited to educational and vocational training for individuals aged 17 and above, and for no other purpose (including any other use within Class F1) without prior written approval from the Local Planning Authority.
Reason:-
To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application. |
| 4. | The maximum number of children/students on the premises at any one time shall not exceed 30.
Reason:-
To prevent noise nuisance to adjoining properties and to protect amenity. |
| 5. | Within 3 months of the permission hereby approved, an Operational Management Plan shall be submitted to and approved in writing by the Local Planning Authority. The plan shall include details of class sizes, session times, staff numbers at any one time, measures to restrict activities (gathering/waiting/children playing) in outdoor areas around the premises which could give rise to disturbance to neighbouring occupiers; and measures to manage student arrivals and departures; complaints process including measures to notify and inform occupiers of nearby residential properties on how to raise issues and procedure for handling complaints. The approved management plan shall be implemented in full and within 1 month of the date of approval by the Local Planning Authority. The approved measures/works in management plan shall be permanently implemented/retained.

| 6. | Prior to the first occupation of the premises for the use hereby approved, a Ventilation Strategy shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall include details of mechanical and/or natural ventilation systems to be installed, demonstrating compliance with relevant health and safety standards for enclosed educational environments. The approved ventilation system shall be installed prior to first use and retained thereafter.
Reason:-
To ensure that the premises are adequately ventilated for the proposed educational use, in the interest of protecting the health, safety, and comfort of future occupants and neighbouring users. |
| 7. | The use hereby permitted shall only be carried out on the site between the hours of 9am and 7pm Mondays to Fridays, and 10am and 16pm on Saturdays, Sundays, Bank or Public Holidays.
Reason:-
To minimise the impact of the development on the surrounding area in the interests of amenity. |
| 8. | The use of the premises shall be varied from clinic use only (as restricted by Condition 3 of planning permission ref. [insert ref]) to use within Class F1 (Learning and Non-Residential Institutions) of the Town and Country Planning (Use Classes) Order 1987 (as amended).
Reason:-
To enable the lawful use of the premises for educational and vocational training purposes within Use Class F1, in line with the Town and Country Planning (Use Classes) (Amendment) (England) Regulations 2020, and to reflect the current planning framework and proposed use. |
| 9. | No amplified sound, public address system, or loudspeaker shall be used within the premises unless a Noise Impact Assessment has first been submitted to and approved in writing by the Local Planning Authority.
Reason:-
To protect the residential amenity of occupants in the flats above the application site. |
| 10. | Prior to the commencement of the use hereby approved, a Noise Management Plan shall be submitted to and approved in writing by the Local Planning Authority. The plan shall include details of noise control measures, internal layout, insulation, and operational practices to minimise noise transmission to adjoining residential properties. The approved plan shall be implemented in full and retained thereafter.
Reasons:-
To ensure that operational practices associated with the educational use are managed in a way that minimises noise impacts on nearby residential occupiers, and to provide clarity and enforceability regarding noise control measures. |
| 11. | A scheme for sound insulation between the application premises and the residential units above shall be submitted to and approved in writing prior to commencement of the use. The approved scheme shall be implemented before the use begins and maintained thereafter.
Reasons:-
To prevent noise disturbance to neighbouring residential properties, particularly those located above the premises. |
| 12. | Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework. |
| 13. | Any signage or external alterations may require separate advertisement or planning consent. |
