| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | The premises shall not be used for the purposes hereby permitted other than between the hours of 08:00 and 20:00 Monday to Friday, 09:00 and 17:00 on Saturday and closed on Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority.
Reason:-
To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 4. | The applicant should note that this planning consent is solely for the change of use from use class A1 (retail) to D1 (physiotherapy clinic) and separate advertisement consent would be required for any signage for the proposed use. |
| 5. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework 2018, improvements required to make the proposal acceptable were negotiated with Mr Shanks (applicant) by phone and e-mail. The revisions involved reducing the height of the fascia sign to be in line with signage on the neighbouring premises. The amendments were subsequently submitted on 30-10-20 & 05-11-20. |
