| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | Prior to the installation of the new flue and extractor system, details of the finish and colour of the flue, which shall match the exterior of the building, shall be submitted and approved in writing by the Local Planning Authority. The new flue and extractor system shall be carried out in accordance with the approved details to the satisfaction of the Local Planning Authority and retained permanently thereafter.
Reason: To ensure that the flue matches the exterior of the building so it blends in and minimises its visual impact on the locally listed building and the streetscene. |
| 4. | Any machinery in connection with the new flue and extractor system hereby permitted shall be operated in accordance with the Noise Impact Assessment provided by DAA Group for 101 Brentwood Road, Romford, RM1 2EH (dated 8 August 2024, Issue 02) and should comply with the following requirement at all times:
The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound."
The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority.
Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant. |
| 5. | The new flue and extractor system hereby approved shall be implemented in accordance with the Kitchen extraction and odour control system proposal provided by Fan Services for 101 Brentwood Road, Romford, RM1 2EH dated 09/08/2024.
Reason: To protect the amenity of occupiers of nearby premises and ensure that the development accords with Policies 7 and 34 of the Havering Local Plan. |
| 6. | Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework. |
