1.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with the Havering Local Plan.
2.This permission shall be for a limited period only expiring on 12th September 2025 on or before which date the use hereby permitted shall be discontinued, the buildings and works carried out under this permission shall be removed and the site reinstated to its former condition to the satisfaction of the Local Planning Authority. Reason: To enable the Local Planning Authority to monitor the impact on pedestrian movement and adjoining residential occupiers, and to ensure that the development accords with the Havering Local Plan.
3.At all times during operation of the use, a removable means of enclosure shall be used to demarcate the seating area Reason: In the interest of highway safety and to ensure that the development accords with the Havering Local Plan.
4.The external tables and seating hereby approved shall be removed from the pavement between the hours of 20.00 and 07:00 hours (the following morning) daily. Reason: In the interests of pedestrian safety and amenity, and to ensure that the development accords with the Havering Local Plan.
5.The outdoor seating area hereby permitted shall consist of no more than four tables and eight chairs and will only be situated inside an area of 1.5m in depth from the front of the building facade and must not extend beyond the existing flank boundaries. Reason: In the interests of pedestrian safety and amenity, and to ensure that the development accords with the Havering Local Plan.
6.No amplified music or speech shall be played or reproduced in the outside pavement seating area. Reason: To prevent noise nuisance to adjoining properties, protect amenity, and in order that the development accords with the Havering Local Plan.
7.Fabric Barrier Design Informative The fabric style street barriers for the external seating area hereby permitted shall be plain black shown as 'Barrier Style' on Drawing No. 2629-16 and not with the advertisements as viewed on site, which will require separate advertisement consent.
8.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
