| 1. | The proposed dwellings would, by reason of their bulk, scale, massing and proximity to the rear boundary of the neighbouring property no. 27 Marlborough Close, result in the encroachment of substantial development towards the rear of this neighbouring property dominating the outlook of and resulting in a loss privacy and overlooking for these neighbouring occupants to the detriment of the enjoyment of their amenity, contrary to the provisions of Local Plan Policy 7. There would also be conflict with paragraph 135(f) of the NPPF, which requires development proposals to to provide a high standard of amenity for existing users. |
| 2. | In the event that this application is allowed through the appeals process, the proposals would be liable for the following CIL contributions:
Mayoral CIL (MCIL2) contribution of £2,250 (x £25 per sqm).
Havering CIL (HCIL) contribution of £12,750 (x £125 per sqm)
Each contribution would be subject to indexation. |
| 3. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with the agent via email on 5th June 2025. The revisions involved reducing the bulk, scale and massing of the rear dormers of the proposed dwellings and amending its window design. The agent declined to make the suggested revisions. |
