1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.During construction of the development hereby permitted, any trees within or near to the site shall be protected in accordance to the tree protection measures contained with the "Arboricultural Method Statement and Tree Protection Plan of Trees relating tot he proposed realignment of the access road serving "Grove Farm" - M25 Junction 28 Improvement scheme" By Writtle Forest Consultancy, dated 06.06.2023. Reason: In order to maintain the existing vegetation at the site, which makes an important contribution to the character of the area, and to accord with Policy 27 of the Council's Local Plan.
3.Soft Landscaping Notwithstanding the indicative details shown on the plans hereby approved, prior to implementation of this section of the project, a scheme of hard and soft landscaping shall be submitted to and agreed in writing by the Local Planning Authority and shall include the following. A. Soft Landscaping scheme shall include: a) Planting plan; b) Written specifications (including cultivation and other operations associated with trees, plants and grass); and c) Schedules of plants and trees, setting out the species, sizes, numbers/densities and soil depths. The scheme shall also include a programme setting out how the plan will be put into practice including measures for protecting plants and trees both during and after development has finished. The new planting shall be carried out in accordance with BS 8545 (2014) 'Trees: from nursery to independence in the landscape' in the first planting and/or seeding season following the substantial completion of the development and shall comply with the requirements specified in BS 3936 (1992) 'Specification of Nursery Stock Part 1 Trees and Shrubs', and in BS 4428 (1989) 'Recommendations for General Landscape Operations'. None of the new trees, plants or shrubs planted shall be lopped or topped within a period of five years from the completion of the development. Any trees, plants or shrubs, which, within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased, shall be replaced in the next planting season, in accordance with the approved scheme. The approved landscaping scheme shall be maintained thereafter. 4.The development shall be carried out in accordance to the mitigating measures secured through the Environmental Management Plan (EMP) which forms part of the DCO permission. In particular, the Ecological Species and Habitats Plan. In particular the measure should include: · Use of wood from the two veteran trees required to be removed will provide dead wood material which will be strategically situated to maximise likely use by saprophytic fungi and invertebrates (Arboricultural assessment during detailed design will determine the appropriate approach to compensation on an individual tree-by-tree basis, and this information will be set out in the Arboricultural Method Statement) . · Veteranisation of suitable retained trees (this information will be set out in the Arboricultural Method Statement and the LEMP). · Creation of dead wood habitats using other felled trees and pruned limbs. · Installation of safe mammal passage on culverts (including a raised otter ledge on new culverts) and any associated fencing. · Creation of ponds (suitable for great crested newt and other wildlife - designs detailed in the LEMP). · Creation of amphibian/reptile hibernacula and refuges. · Installation of bird nesting boxes. · Installation of bat roost boxes. The project is not subject to Biodiversity Net Gain requirements as these don't get implemented under DCOs until 2025, but National Highways has its own targets which it sets for each scheme. Environmental mitigation in the area of the Grove Farm Egress includes: · Installation of bat and bird boxes in Grove Wood · Retention of deadwood features from the veteran trees for invertebrates in Grove Wood · Landscape planting taking the form of trees and shrubs with a species rich grassland understorey Reason; In the interest of nature conservation.
5.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
6.You are informed that this application only relates to a small part of the site, relating to the egress into Grove Farm Industrial Estate as shown on the area highlighted in "purple" on drawings numbered TR010029/APP/2.8 Rev 2 andTR010029/APP/2.8 Rev 2 (/sheet 1 of 4).
