| 1. | The dwelling proposed through its height, scale, bulk, mass and position on the site would detract from the special character of the adjacent Grade II Listed Blue Boar Hall through harm to its open setting and result in harm to the Conservation Area, owing to its prominence in views from within and across the historic green. The scheme would therefore fail to contribute positively to local character and distinctiveness, as required by Para. 210 (c) , would lead to less than substantial harm not outweighed by public benefit as required by Para. 215 of the National Planning Policy Framework. Accordingly the proposals would be contrary also to Havering Local Plan Policies 26 and 28, London Plan Policy HC1 and the objectives of the Planning (Listed Buildings and Conservation Areas) Act 1990 (in particular sections 66 and 72). |
| 2. | The proposals, if granted planning permission on appeal and if not exempt, would be liable for the Mayor of London and Havering Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the Mayoral CIL payable would be £3,120 based on the calculation of £25.00 per square metre and the Havering Community Infrastructure Levy (HCIL) would be a charge of £15,600 based on calculation of £125 per square metre. Each would be subject to indexation.

| 3. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the applicant/agent in writing 14 January 2026 and subsequently following discussion with the applicant 27 Jan 2026 with it agreed that a decision was preferred. |
