1.The proposed development would, by reason of its position and proximity to neighbouring properties cause overlooking and loss of privacy which would have a serious and adverse effect on the living conditions of adjacent occupiers, contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
2.The proposed development would, by reason of the substandard provision of accommodation and poor quality internal layout, combined with the poor and cramped amenity space provision, create a cramped, contrived, and uncomfortable layout of the site to the detriment of future occupiers and the character of the surrounding area contrary to Policy 3.5 of the London Plan, Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and the Adopted London Borough of Havering SPD on Residential Design 2010. The proposal would be contrary to the implementation of the DCLG Technical Housing Standards - Nationally Described Space Standard March 2015.
3.The proposed development would, by reason of its excessive height, bulk and position close to the boundaries of the site, be an intrusive and unneighbourly development as well as having an adverse effect on the amenities of adjacent occupiers, particularly those at No. 13 Grenfell Avenue, contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
4.Please be advised that approval of this application from 1st September 2019 (either by London Borough of Havering, or subsequently by PINS if allowed on appeal following a refusal by London Borough of Havering) will attract a liability payment of £91 500 subject to indexation in Community Infrastructure Levy (CIL). This charge has been levied under s.206 of the Planning Act 2008 and includes both the Mayor of London's CIL and Havering Council's CIL. The proposed development would create 610m² of internal floor area. The proposal is liable for Mayoral CIL and will incur a charge of £15, 250.00 based on the calculation of £25.00 per square metre. Havering's charging rate for residential development is of ¿£125/sq.m (Zone A), ¿and £55/sq.m (Zone B). In zone A the and the property is liable for a contribution of £76,250 subject to indexation. 5.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework 2018, improvements required to make the proposal acceptable were negotiated with Tim Cropper via email and telephone. The revisions involved amendments to the proposal to make it acceptable including to the layout of the scheme. The applicant declined to make the suggested revisions.
