| 1. | The proposal would give rise to a poor quality living environment for future occupiers by reason of the design and layout of the development, including the poor outlook from single aspect units (flats 1, 3, 4, 5, 7 and 9), limited light to Flats 1, 5 and 9, which are single aspect, north facing units, insufficient floor to ceiling height and the poor access arrangements for the proposed flats. The proposal would be contrary to Policies 7 and 26 of the Havering Local Plan, Policy D6 of the London Plan and the National Planning Policy Framework. |
| 2. | The proposed building would, by reason of its height, scale, bulk, mass, siting, materiality, lack of articulation and position close to the boundaries of the site, appear incongruous, visually overbearing and cramped in the streetscene harmful to the character and appearance of the surrounding area and combined with the depth of its rear projection, particularly on the third and fourth floors, appear overbearing, dominant and visually intrusive harmful to the amenity of neighbouring properties contrary to Policies 7 and 26 of the Havering Local Plan, Policy D4 of the London Plan and the guidance contained in the National Planning Policy Framework. |
| 3. | In the absence of a noise report and given the proximity of the proposal to an electrical substation, it has not been sufficiently demonstrated that the proposed development would provide a good quality living environment for future occupiers in terms of noise, contrary to Policies 7 and 34 of the Havering Local Plan, Policies D13 and D14 of the London Plan and the National Planning Policy Framework. |
| 4. | The two retail car parking spaces would, by reason of their siting and proximity to the proposed building and the junction of London Road and Burlington Avenue combined with the layout of the proposed development, result in inadequate access and egress arrangements harmful to highway and pedestrian safety contrary to Policies 23 and 24 of the Havering Local Plan, Policy T4 of the London Plan and the National Planning Policy Framework. |
| 5. | The proposal fails to demonstrate that the proposed development would provide adequate servicing, delivery and refuse collection arrangements for both the commercial and residential elements of the scheme. Furthermore, in the absence of a legal agreement to prevent future occupants from applying for or obtaining a residents parking permit, the proposal fails to satisfactorily mitigate the parking impacts of the development. As such the proposal is likely to result in inadequate arrangements for the servicing of the site, to the detriment of highway safety and residential amenity contrary to Policies 7, 23 and 24 of the Havering Local Plan, Policies T4, T6.1 and T7 of the London Plan and the National Planning Policy Framework. |

| 7. | For mixed use development
Please be advised that approval of this application from 1st September 2019 (either by London Borough of Havering, or subsequently by PINS if allowed on appeal following a refusal by London Borough of Havering) will attract a liability payment of £132,475 plus indexation in Community Infrastructure Levy (CIL). This charge has been levied under s.206 of the Planning Act 2008 and includes both the Mayor of London's CIL and London Borough of Haverings CIL.
London Borough of Havering, as CIL collecting authority, has responsibility for the collection of the Mayoral CIL, in addition to Havering's CIL, on commencement of the development.
