| 1. | The reduction in height from between approximately two and a half to three metres to two metres of the brick wall on the boundaries of the site would contravene the requirements of condition 3 of planning permission reference P0685.23 and would fail to provide the appropriate level of security and living conditions for neighbouring properties. The provision of new boundary walls to directly replace the solid and secure boundary currently provided by the existing garages was also found to be necessary to safeguard security and living conditions for surrounding residents by the Inspector who determined the previous appeal at the site under appeal reference APP/B5480/W/20/3262088 and there have been no material changes at the site or surrounding area which would justify a different conclusion being reached at the present time. The proposal is therefore considered be unacceptable and harmful to neighbouring amenity and thereby contrary to Policies 7 and 26 of the Havering Local Plan 2016-2031 adopted November 2021, Policy D11 of the London Plan 2021 and the objectives of the National Planning Policy Framework 2024. |
| 2. | The plans show changes that are inconsistent with the previously approved plans for planning application P0685.23 and go beyond the Section 73 application sought. |
| 3. | In accordance with Article 35 of the Town and Country Planning (Development Management Procedure Order) 2015 the LPA has acted positively and proactively in assessing this application. The Authority has engaged constructively with the applicant by enabling the opportunity for further information to be provided by a qualified structural engineer including details of all the strengthening works required and to show these works on the drawings to be submitted and to amend inconsistencies on the submitted drawings. Despite this, the proposal is not capable of overcoming the identified planning harm and the LPA is unable to support the proposal. As such, it is considered appropriate that the application be brought to determination, which will enable the applicant to make use of the available appeal process should they wish to do so. |
