| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | All new external finishes shall be carried out in materials to match those of the existing building(s) to the satisfaction of the Local Planning Authority.
Reason:-
To safeguard the appearance of the premises and the character of the immediate area, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61. |
| 3. | The details provided to the Local Planning Authority as shown on drawing no. 004 for the proposed site layout / foundation plan which contains details of the underground measures to protect roots, the control of areas around the trees and other measures necessary for the protection of the trees shall be implemented before development commences and kept in place until the approved development is completed.
Reason:-
To protect the health and safety of the adjacent park trees. Insufficient information has been supplied with the application to demonstrate how the preserved trees on site will be adequately protected during construction. Submission of details prior to commencement will ensure that the measures to be employed are robust. |
| 4. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 5. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no porches shall be erected to the front or side of the extension hereby permitted, without the express permission in writing of the Local Planning Authority.
Reason:-
In the interests of amenity and to enable the Local Planning Authority to retain control over future development, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 6. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no window or other opening (other than those shown on the submitted and approved plan,) shall be formed in the flank wall(s) of the building(s) hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority.
Reason:-
In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 7. | The roof area of the extension hereby permitted shall not be used as a balcony, roof garden or similar amenity area without the grant of further specific permission from the Local Planning Authority.
Reason:-
In the interests of the amenity of the occupiers of neighbouring dwelling, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61. |
| 8. | The applicant is advised that this planning permission does not grant permission for any part of the development to encroach onto any property/land not within the applicant's ownership. |
| 9. | Should the applicant wish to carry out any works to any of the parks trees adjacent to the application site outside of the normal parks maintenance regime ( e.g. the cutting back of side growth growing towards the site boundary) , the applicant is advised to engage the services of a tree surgeon who is registered with the Arboricultural Association (see https://www.trees.org.uk/Find-a-professional) and for that professional to email the Council's parks service at parks@havering.gov.uk and CC tim.goldrick@havering.gov.uk with details of what work they plan to carry out, to supply a Method Statement and a Risk assessment as well as a copy of their Public Liability Insurance up to £5 million. The parks department's express permission must be obtained before any work is carried out; the granting of the planning permission and / or the advice contained within the planning decision notice is not to be construed in any way as consent for works to trees outside the curtilage of 319 Dagnam Drive. |
| 10. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012. |
