| 1. | The proposal would provide accommodation which is below the gross internal floor area required. It is considered that the shortfall in floor-space would result in a substandard level of living space for future occupiers. In addition, the internal layout of the proposals is such that bedrooms would abut primary habitable rooms of the attached property which would harmful to the amenity of occupiers of both the proposed dwellings and no.79 Birkbeck Road. The proposals are therefore contrary to Policy DC4, Policy DC61 of the LDF Core Strategy and Development Control Policies DPD, the Residential Design SPD and Policy 3.5 of The London Plan. |
| 2. | In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan. |
| 3. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with para 186-187 of the National Planning Policy Framework 2012, improvements required to make the proposal acceptable were negotiated with the agent by telephone/email September 2016. The revisions involved the reduction in the number of bedrooms/creation of additional floor area to make up the shortfall in GIA. The applicant declined to make the suggested revisions. |
