| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the use hereby permitted shall be an indoor recreation centre and associated cafe (Use Class E) only and shall be used for no other purpose(s) whatsoever including any other use in Class E of the Order, unless otherwise agreed in writing by the Local Planning Authority.
Reason:-
To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application. |
| 3. | The premises shall not be used for the purposes hereby permitted other than between the hours of 09:00 and 22:00 Monday to Saturday and Bank or Public Holidays and 09:00 and 17:00 on Sundays without the prior consent in writing of the Local Planning Authority.
Reason:-
To enable the Local Planning Authority to retain control in the interests of amenity. |
| 4. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 5. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with Jacs Projects LLP via email on 7th December 2023. The revisions involved amending the car parking layout plan. The amendments were subsequently submitted on 13th December 2023. |
| 6. | The applicant is reminded that the business should put in place a suitable contract for the collection of commercial waste from the site. |
