1.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
2.Within two months of the date of this decision, the pallet racks within no. 80 Lower Bedford Road shall be removed from the site and the double storey storage containers within no. 82 Lower Bedford Road shall be re-located to the rear of the site as depicted on the drawing 2772/12 submitted with the application and evidence of this shall also be submitted to the Local Planning Authority. Reason:- To ensure that the development is carried out as approved and has an acceptable design and complies with Policy 26 of the Havering Local Plan (2021).
3.No. 80 Lower Bedfords Road shall not be used for the purposes hereby permitted other than between the hours of 09:00 and 16:30 on Mondays to Fridays and not at all on Saturdays, Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
4.No. 82 Lower Bedfords Road shall not be used for the purposes hereby permitted other than between the hours of 09:30 and 16:30 on Mondays to Saturdays and not at all on Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
5.Within three months of the date of this decision, an Air Quality Neutral Assessment shall be submitted to the Local Planning Authority for no. 82 Lower Bedfords Road. The assessment must comply with London Air Quality Neutral guidance and updated guidance, at the time the report is submitted. The assessment shall detail; Calculations of the predicted building emissions and comparison against the Building Emission Benchmarks; Mitigation (if required) or contribution to off-setting the development's emissions, taking into account the most up to date Defra's damage costs and relevant guidance on offsetting payments. Unless the assessment approved is implemented within two months of the Local Planning Authority's approval, the use of the site as a vehicle recovery business shall cease until such time as an assessment is approved and implemented. The assessment shall be fully implemented and the use of the site maintained in accordance with the approved details, with evidence of the assessment's implementation submitted to the Local Planning Authority. If no assessment in accordance with this condition is approved within five months of the date of this decision, the use of the site as a vehicle recovery business shall cease until such time as an assessment approved by the Local Planning Authority is implemented. Reason: To ensure that the development will not lead to further deterioration of existing poor air quality within the designated Air Quality Management Area and to comply with Policy SI 1 of the London Plan and relevant guidance, as subsequently amended.
6.No plant or machinery shall be used within the site unless it meets, or mitigation is employed, to meet the following standard: The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound". The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with. Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant.
7.The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material planning considerations, including planning policies and any representations which were received. It subsequently determined to grant planning permission in accordance with the National Planning Policy requirement that applications for sustainable development are approved where possible. A detailed analysis of the scheme is set out in the report on the application prepared by officers.
