1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The rear of the shop unit indicated to be used for vehicle diagnosis shall be used only as an integral part of the main shop unit and not as a separate planning unit or business and shall operate only between the hours of 9:00 and 18:00 Monday to Saturday and 10:00 and 14:00 Sundays, Bank and Public Holidays. Reason:- In the interests of neighbouring amenity and to accord with the description given by the applicant.
4.External access doors serving the vehicle diagnosis (rear of the building) shall remain closed when any noisy works are occurring save for the ingress and egress of people and goods. Reason: To prevent noise nuisance to adjacent properties.
5.No deliveries shall be taken at or despatched from the site outside the hours of 08:00-18:00 Monday - Friday, 08.00-17.00 Saturday nor at any time on Sundays, Bank or Public Holidays. Reason: In order to protect amenity of the area
6.No plant or machinery shall be installed unless it meets, or mitigation is employed, to meet the following standard: The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound". The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with. Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant.
7.No demolition or construction works, or deliveries, into the site shall take place other than between the hours of 08.00 to 18.00 on Monday to Friday and 08.00 to 13.00 hours on Saturdays unless agreed in writing with the local planning authority. No demolition or construction works, or deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the local planning authority. Reason: To protect residential amenity
8.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with the agent. The revisions involved alterations to the elevation drawings to ensure accuracy of the existing arrangement. The applicant submittd revised plans 03-10-2023 and the Council undertook further consultation.
9.The applicant is advised that should the activities undertaken at the site change in character and frequency to that described here that a change of use may be considered to have occurred and that planning permission may then be required. Any unauthorised use could be subject to Enforcement action.
