| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | The scheme to control noise and vibration, as detailed in the noise report provided by Noise Assessments Consultants (v3, dated 16 March 2026) submitted with this application shall be implemented, as a minimum, before the hereby permitted use commences.
Such a scheme as approved shall be implemented prior to first use and thereafter retained and maintained in accordance with such details, and should comply with the following requirement at all times:
The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound.
The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with.
Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant. |
| 4. | The odour abatement measures set out in 'Ventilation and Extraction Statement Revision A' submitted as part of this application shall be maintained in perpetuity in relation to the development hereby permitted to satisfaction of the Local Planning Authority and during any period that these measures are removed, use of the development must cease.
Reason: To protect the amenity of occupiers of nearby premises. |
| 5. | Approved Proposal Informative
The applicant should note that the Council have only considered the installation of the extraction fan to rear of building. as part of this application. It is acknowledged that certain change of use can be done under permitted development, however, the applicant needs to be satisfied that they have correctly interpreted permitted development criteria and should they wish to obtain a legally binding document then a Certificate of Lawfulness can be submitted to corroborate this. Should any subsequent use of the property transpire to require planning permission then this may be subject to enforcement action taken by the Council.
Furthermore, separate consent will be needed for any advertisement to the front of the existing building. |

| 7. | The Local Planning Authority has acted positively and proactively in determining this application by assessing the proposal against all material planning considerations, including planning policies and any representations which were received. It subsequently determined to grant planning permission in accordance with the National Planning Policy requirement that applications for sustainable development are approved where possible.
