| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 the garage(s)/workshop(s)/utility room(s)/ outbuilding(s) hereby permitted shall be used only for purposes incidental to the enjoyment of the dwelling house and not for any trade or business nor as living accommodation.
Reason:-
To restrict the use to one compatible with a residential area. |
| 4. | No plant or machinery shall be installed unless it meets, or mitigation is employed, to meet the following standard:
The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound"
The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with.
Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant. |
| 5. | The charging points hereby permitted shall be capable of being used only during operating hours of the store and at no other time outside of those hours. Outside of store operating hours the equipment shall be made unavailable for use and any illumination ceased.
Reason: To protect the amenity of nearby premises. |
| 6. | Any new or replacement hard-surfacing shall match the existing and any levels made good to reflect the existing to the satisfaction of the Local Planning Authority.
Reason: In the interests of good design/visual amenity. |
| 7. | Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework. |
| 8. | A clear sign with instructions should be located near the charging points to indicate that the bays are reserved for those charging only. |
