1.This permission shall be for a limited period only expiring on the earlier of either: - 31 May 2029; or - three years from the date of approval of reserved matters for this site, pursuant to outline planning permission P0761.20 on or before which date the use hereby permitted shall be discontinued, the cabins and associated equipment removed and the site reinstated to its former condition and use to the satisfaction of the Local Planning Authority. Reason: The proposal is intended to be a meanwhile use and as such a temporary use would not be prejudicial to the redevelopment of the Waterloo Estate Redevelopment.
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
3.No development shall take place until a scheme for tree protection measures (both above and below ground) to be implemented during the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall include: * Details of a construction exclusion zone (including protective fencing of a height and design which accords with the requirements BS 5837: 2012) to be formed around the root protection areas of the two trees adjacent to Cotleigh Road to be retained; * Details of any excavation to take place within the root protection areas of those trees to be retained; * Details of the foundations of any building, hardstandings and/or boundary treatments to be constructed within the root protection areas of those trees to be retained. The development shall thereafter be carried out in strict accordance with the protection measures contained within the duly approved scheme throughout the entirety of the construction period. Reason: To ensure that adequate measures are put in place to protect existing trees which are to be retained as part of the development before any construction works commence.
4.Notwithstanding the details shown on the approved drawings, the development hereby approved shall not progress beyond 150mm above ground level until the details of the materials to be used in the construction of the external surfaces noted below and elements within the site have been submitted to and agreed in writing by the Local Planning Authority: - a) all facing materials for the buildings; b) water bowser; and, c) lighting within the site. The development shall be carried out in accordance with the approved details and shall be retained thereafter. Reason: To safeguard the appearance of the buildings and the character of the immediate area.
5.No works shall take place in relation to any of the development hereby approved until details of surface water drainage works are submitted to and approved in writing by the Local Planning Authority. Surface water drainage shall be provided in accordance with the approved details. Reason: Surface water drainage works are required on site to prevent the risk of flooding. Submission of a scheme prior to commencement will ensure that the measures to be employed are technically sound.
6.Notwithstanding the approved drawings, prior to the use first being brought into operation a hard and soft landscaping scheme including boundary treatments for the site shall be submitted to and approved in writing by the Local Planning Authority. Such a scheme shall include details of: * All tree, hedge, shrub and other planting proposed as part of the scheme * Materials, levels and construction (including sub layers and surfacing materials) and drainage of all hard surfaced areas * New security fences and gates. The development shall be carried out in accordance with the approved details and shall be retained thereafter. Reason: To ensure appropriate landscaping of the site in the interests of visual amenity, to enhance the character of the street scene and to provide biodiversity enhancements with details to ensure plant establishment and appropriate management is carried out to comply with Havering Local Plan Policy 27, 29 and 30.
7.All mitigation measures and/or works shall be carried out in accordance with the details contained in the Preliminary Ecological Appraisal (Arborweald, December 2024) as already submitted with the planning application and agreed in principle with the Local Planning Authority prior to determination. Reason: To conserve and enhance protected and Priority species and allow the LPA to discharge its duties under the Conservation of Habitats and Species Regulations 2017 (as amended), the Wildlife & Countryside Act 1981 (as amended), s40 of the NERC Act 2006 (as amended).
8.Prior to the commencement of work above ground level a Biodiversity Enhancement Strategy for protected, Priority and threatened species shall be submitted to and approved in writing by the local planning authority following the recommendations made within the Preliminary Ecological Appraisal (Arborweald, December 2024). The content of the Biodiversity Enhancement Strategy shall include the following: a) Purpose and conservation objectives for the proposed enhancement measures; b) detailed designs or product descriptions to achieve stated objectives; c) locations, orientations, and heights of proposed enhancement measures by appropriate maps and plans; d) persons responsible for implementing the enhancement measures; e) details of initial aftercare and long-term maintenance (where relevant). The works shall be implemented in accordance with the approved details prior to occupation and shall be retained in that manner thereafter. Reason: To enhance protected, Priority and threatened species and allow the LPA to discharge its duties under the NPPF 2024 and s40 of the NERC Act 2006 (as amended).
9.The temporary cabins shall not be used for the purposes hereby permitted other than between the hours of 0800 Hours and 2100 Hours each day of the week. Reason: - To enable the Local Planning Authority to retain control in the interests of amenity.
10.Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the cabin building hereby permitted shall be (F1(f) only and shall be used for no other purpose(s) whatsoever including any other use in Class (F) of the Order. Reason:- To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application.
11.Before the cabins hereby permitted are first brought into use, the area set aside for car parking shall be laid out to provide five disabled bays and retained until cessation of the permission for the accommodation of vehicles visiting St Andrews Church or the cabins hereby approved and shall not be used for any other purpose. Reason:- To ensure that car parking accommodation is made permanently available to the standards adopted by the Local Planning Authority in the interest of highway safety.
12.The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition "(the biodiversity gain condition") that development may not begin unless: (a) a Biodiversity Gain Plan has been submitted to the planning authority, and (b) the planning authority has approved the plan. The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan if one is required in respect of this permission would be the London Borough of Havering. There are statutory exemptions and transitional arrangements which mean that the biodiversity gain condition does not always apply. These are listed in paragraph 17 of Schedule 7A of the Town and Country Planning Act 1990 and the Biodiversity Gain Requirements (Exemptions) Regulations 2024. Based on the information available this permission is considered to be one which will require the approval of a biodiversity gain plan before development is begun because none of the statutory exemptions or transitional arrangements are considered to apply.
