1.Subject to Conditions 9 (cycle storage) and 10 (travel plan) (which place a greater limitation on floorspace should those conditions not be satisfied): Unit C shall be used for retail sale of goods only. No more than 30% (540sq.m) of the gross floorspace of this Unit shall be used for the sale of food and drink products, of which no more than 5% of the gross floor space (i.e. 90sqm) shall be used for the sale of fresh or frozen foods. Reason:- To enable local Planning Authority to exercise control over any future use not forming part of the application.
2.Subject to Conditions 9 (cycle storage) and 10 (travel plan) (which place a greater limitation on trading hours should those conditions not be satisfied): Unit C shall not trade other than between the hours of 8am to 8pm on Mondays to Saturdays and 10am to 5pm on Sundays. Reason; In the interest of amenity.
3.Subject to Conditions 9 (cycle storage) and 10 (travel plan) (which place a greater limitation on delivery hours should those conditions not be satisfied): No deliveries to or from the units hereby permitted shall take place other than between the hours of 7.30am to 8.00pm on Mondays to Saturdays and 10am to 5pm on Sundays. Reason In the interest of amenity.
4.Notwithstanding the provision of the Town and Country Planning (General Permitted Development) Order 1995, no window or other opening (other than those shown on the submitted plan, a copy of which is attached), shall be formed in the flank or rear wall(s) of the building(s) hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority. Reason; In order toe ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future.
5.No goods or materials shall be stored in the open. Reason; In the interest of visual amenity
6.No bunting, flags or other external decorative material shall be displayed on site unless otherwise agreed in writing by this Local Planning Authority. Reason; In the interest of visual amenity
7.No additional extract ventilation, air conditioning or similar equipment shall be installed in the units hereby permitted unless full details of its specifications, location, external discharge points, design and acoustic performance have first been submitted to and approved in writing by this Local Planning Authority. The system(s) shall be installed and fully maintained in accordance with the approved details. Reason; In the interest of the amenity
8.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
9.Notwithstanding conditions 1, 2 and 3; the area of Unit C for sale of food and drink shall be limited to 20% (360 sq. m) with no sale of fresh and frozen food; Unit C shall not trade other than between 8am to 8pm, Monday to Saturdays and 10am to 5pm Sundays, Bank and Public Holidays; No deliveries shall take place other than between 7.30am to 8pm Mondays to Saturdays with no deliveries on Sundays, Bank or Public Holidays; unless and until: Cycle storage of a type and in a location previously submitted to and agreed in writing by the Local Planning Authority shall be provided and permanently retained thereafter. Reason:- In the interests of providing a wide range of facilities for non-motor car residents, in the interests of sustainability.
10.Notwithstanding conditions 1, 2 and 3; the area of Unit C for sale of food and drink shall be limited to 20% (360 sq. m) with no sale of fresh and frozen food; Unit C shall not trade other than between 8am to 8pm, Monday to Saturdays and 10am to 5pm Sundays, Bank and Public Holidays; No deliveries shall take place other than between 7.30am to 8pm Mondays to Saturdays with no deliveries on Sundays, Bank or Public Holidays; unless and until: A Travel Plan in accordance with the aims and objectives of National Planning Policy Framework (March 2019) is submitted to and agreed in writing by the Local Planning Authority. Subsequent to approval, the Travel Plan measures shall be implemented in full and be monitored for a period of 1 year from the date of approval and the results submitted in writing to the Local Planning Authority. Reason: In the interests of encouraging safe and sustainable modes of travel and to accord with Policy DC32 of the LDF Development Control Policies Development Plan Document.
11.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework 2018, improvements required to make the proposal acceptable were negotiated with the applicants agent by email. The revisions involved changes in the wording of the condition. The amendments were subsequently submitted on 12th February 2021.
