1.The premises, including any outdoor areas, shall not be used for the purposes hereby permitted other than between the hours of 09:00 to 23:30 on Monday to Wednesday, 09:00 to 00:30 on Thursday, 09:00 to 01:30 on Friday, Saturday and Bank Holidays and 09:00 to 23:30 on Sunday without the prior consent in writing of the Local Planning Authority. Reason:- To protect the amenity of nearby residential properties and in order that the development accords with Development Control Policies Development Plan Document Policy DC23 and DC55.
2.Noise levels (expressed as the equivalent continuous sound level, LAeq) (1hr) from fixed plant and machinery at the boundary with of the nearest noise sensitive premises shall not exceed LA90-10dB. Reason: To protect the amenity of adjoining/nearby residents and a in order that the development accords with Development Control Policies Development Plan Document Policy DC23 and DC55.
3.Prior to the extended opening hours hereby approved coming into force, a noise limiter shall have been installed in any room within the premises where live or recorded amplified music is to be played. The noise limiter once installed shall be set and sealed by suitably qualified officers from the local authority (Public Protection) and shall be in use when the venue is open for noise generating events where live or recorded amplified music is played. Reason: To protect the amenity of adjoining/nearby residents and in order that the development accords with Development Control Policies Development Plan Document Policy DC23 and DC55.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012.
