1.If at any time after the First Export Date the development hereby permitted ceases, for a period of no less than six months, to export electricity to the electricity grid then the solar panels, mounting frames, buildings, fencing, and all associated structures, shall be removed and the site restored in accordance with the Decommissioning and Restoration Scheme previously approved under condition no. 4 of permission P0907.14 (appeal reference APP/B5480/A/14/2227508) above, unless otherwise agreed in writing by the local planning authority. Reason In the interests of visual amenity and the openness of the Green Belt.
2.This grant of planning permission shall expire no later than 16th December 2056 based on the 40 year period from the date when electricity was first exported from the solar panels to the electricity grid. Reason: In the interests of visual amenity and the openness of the Green Belt.
3.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
4.The trees planted along the eastern side of the site, in accordance with condition 6 and 7 of P0907.14 (APP/B5480/A/14/2227508) which is intended to screen the development from the M25, shall be retained and maintained during the life of the project. If any of the trees die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless otherwise agreed in writing by the local Planning Authority. Reason: In the interests of highway safety.
5.The development shall continue to be undertaken in accordance with the landscaping approved in accordance with condition 6 and 7 of P0907.14 (APP/B5480/A/14/2227508) and retained as such for the life of the development. Reason: In the interests of visual amenity and biodiversity.
6.The CCTV scheme as approved in accordance with condition 8 of P0907.14 (APP/B5480/A/14/2227508) shall be maintained for the life of the development. Reason: In the interests of security and visual amenity.
7.The boundary treatment, as approved in accordance with condition 8 of P0907.14 (APP/B5480/A/14/2227508) ,shall be retained. Reason: To protect the visual amenities of the development.
8.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with the agent with respect to the wording of the condition.
9.You are informed that the Highways Agency has maintained the right way over the land occupied by the solar farm which is required for the widening of the M25. Any extension of time would be null and void upon the grant of consent order for the road widening when the solar farm would be demolished to make way for the extension of M25 in due course.
