1.The extension hereby permitted shall not be carried out otherwise than in complete accordance with the dimensions and appearance shown on the approved plans (as set out on page one of this decision notice). NOTE: This permission relates solely to the extension and not in any way to the use and internal layout of the property - see Informative 1. Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
2.The parking area to the front of the house shown on plan 5a as Front Garden shall be retained permanently for the accommodation of vehicles visiting the site and shall not be used for any other purpose. Reason:- To ensure that car parking accommodation is made permanently available to the standards adopted by the Local Planning Authority in the interest of highway safety, and that the development accords with the Development Control Policies Development Plan Document Policy DC33.
3.This decision is made on the basis that the lawful use of the premises is either a C3 dwelling or C4 house in multiple occupation for up to 6 persons, using rights under Part 3 of the Town and Country Planning (General Permitted Development) (England) Order 2015. To qualify as a C4 HMO, the individual rooms must not be self contained or contain any cooking facilities. Sufficient communal cooking facilities for all residents use should be provided. Note: From 13th July 2016, any new change of use from C3 to C4 would require planning permission by virtue of Article 4 Direction.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with para 186-187 of the National Planning Policy Framework 2012, improvements required to make the proposal acceptable were negotiated with Joel Gray by telephone on the 3 May 2016. The revisions involved the provision of one of the extended rooms as a communal kitchen for the occupiers of the house. The amendments were subsequently submitted on 5 May 2016.
