1.The development hereby permitted shall not be carried out otherwise than in accordance with the list of approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
2.Notwithstanding the details on the submitted plans, the flank window adjacent to No.62 Marks Road, Romford shall be permanently glazed with obscure glass not less than 4 on the standard scale of obscurity and shall thereafter be maintained and permanently fixed shut. Reason:- In the interests of privacy, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61
3.Unless within 3 months of the date of this decision, the following measures need to be undertaken, the polycarbonate material currently in situ on the flank wall adjacent to No.62 Marks Road, Romford will be removed and be replaced with a solid non-transparent material. The flank window adjacent to No.62 Marks Road will have obscure glazing and be fixed shut as shown on drawing 2 REV NO. D, otherwise, the single storey rear extension to be retained hereby permitted shall be demolished to ground level and all materials resulting from the demolition shall be removed. In the interest of privacy and to protect the amenity of the adjacent neighbours at No.62 Marks Road, Romford in accordance with the Residential Extensions and Alterations Supplementary Planning Document and Policy DC61 of the LDF Core Strategy and Development Control Policies Development Plan Document.
4.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no window or other opening (other than those shown on the submitted and approved plan) shall be formed in the flank wall(s) of the building(s) hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority. Reason:- In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
5.The roof area of the extension hereby permitted shall not be used as a balcony, roof garden or similar amenity area without the grant of further specific permission from the Local Planning Authority. Reason:- In the interests of the amenity of the occupiers of neighbouring dwelling, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61.
6.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework 2018, improvements required to make the proposal acceptable were negotiated with Mrs Mohamed (Agent) by phone. The revisions involved making the flank windows obscured glazed and for the polycarbonate side elevation to be removed and be replaced with a non-transparent material. The amendments were subsequently submitted on 13/02/19 and 22/02/19.
