1.The proposed development would, by reason of its excessive scale, bulk and mass, poorly relate to the existing dwelling and would appear as an unacceptably dominant and visually intrusive feature in the rear garden, harmful to the character and appearance of the surrounding area, contrary to the Residential Extension and Alteration Supplementary Planning Document and Policy DC61 of the LDF Core Strategy and Development Control Policies Development Plan Document.
2.The proposed first floor extension/balcony would result in a development that would be intrusive, unneighbourly, oppressive and give rise to an undue sense of enclosure to the detriment of residential amenity and would have an adverse effect on the amenities of that occupier, contrary to the Residential Extensions and Alterations Supplementary Planning Document and Policy DC61 of the LDF Core Strategy and Development Control Policies Development Plan Document.
3.The proposed first floor balcony would, by reason of its position and proximity to neighbouring properties, result in a perceived and actual loss of privacy due to overlooking which would have a serious and adverse effect on the living conditions of adjacent occupiers, contrary to the London Borough of Havering Supplementary Planning Document for Residential Extensions and Alterations and DC61 of the LDF Core Strategy and Development Control Policies Development Plan Document.
4.Statement Required by Article 31 (cc) of the Town and Country Planning (Development Management) Order 2010: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal, rather than negotiation, was in this case appropriate in accordance with para 186-187 of the National Planning Policy Framework 2012.
