1.The site is within the area identified in the Core Strategy and Development Control Submission Development Plan Document Policy Plan as Metropolitan Green Belt. The Core Strategy and Development Control Submission Development Plan Document Policy and Government Guidance as set out in the National Planning Policy Framework states that in order to achieve the purposes of the Metropolitan Green Belt it is essential to retain and protect the existing rural character of the area so allocated and that new building will only be permitted outside the existing built up areas in the most exceptional circumstances. The special circumstances case submitted is not considered to amount to the very special circumstances needed to warrant a departure from this policy and the proposal is therefore contrary to Policy DC45 of the LDF Core Strategy and Development Control Policies Development Plan Document.
2.The proposed development would, by reason of the proposed bungalow with new vehicular access onto Bower Farm Road and access drive/hardstanding and domestic landscaping, introduce urbanisation to a currently open (undeveloped) area which would be out of character in the Village and its Green Belt location resulting in harm to visual amenity in the Streetscene contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
3.The proposal would result in the loss of a significant number of protected trees at the application site reducing its verdant nature within the Conservation Area and adversely affecting the character and appearance of the Conservation Area and visual amenity in the area locally, contrary to Policies DC60 and DC68 of the LDF Core Strategy and Development Control Policies DPD.
4.In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan.
5.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the agent via email on 14/12/16.
6.The proposal, if granted planning permission on appeal, would be liable for the Mayor of London Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the CIL payable would be £4060. Further details with regard to CIL are available from the Council's website.
