| 1. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).

For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 2. | Within 3 months of the date of this decision, full details shall be submitted to the Local Planning Authority, demonstrating that the hereby approved plant or machinery meets the following standard:
The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound.
The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with.
Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant. |
| 3. | The hours of use for the premises and the flue shall be 09:00 and 18:00 on Mondays to Saturdays and between the hours of 10:00 and 17:00 Sundays and not at all on Bank or Public holidays without the prior consent in writing of the Local Planning Authority.
Reason: To protect the amenity of the neighbouring occupiers. |
| 4. | Within 3 months of the date of this decision, the flue under consideration as part of this application will be painted no other colour than black and retained as such, to minimise the visual impact on the surrounding area.
Reason: To protect the visual amenity of the surrounding area. |
| 5. | This permission solely relates to the installation of external flue, new rear door and window size change to first floor. The change of use can be done under permitted development and therefore does not require planning consent. Separate consents will be needed for the awning and any advertisement to the front of the proposed restaurant and to change the hours imposed as part of condition no.2 on P1481.18. |

| 7. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with Mr Brandon (Agent) by phone and e-mail. The revisions involved relocating the flue following concerns that the initial proposal was adjacent to a bedroom window. Revised plans were received and neighbours were re-consulted. The amendments were subsequently submitted on 10/01/24. |
