1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.Prior to commencement of the relevant works of the development the details of railings and privacy screen in order to prevent overlooking onto adjoining gardens shall be provided and approved in writing by the Local Planning Authority. The scheme shall then be implemented in accordance to the approved scheme and retained as such thereafter. Reason:- Insufficient information has been supplied with the application to judge the appropriateness of any boundary treatment. Submission of this detail prior to occupation in the case of new building works or prior to the use commencing in the case of changes of use will protect the visual amenities of the development, prevent undue overlooking of adjoining property and ensure that the development accords with policy 7 of the adopted local plan 2021.
3.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
4.The roof areas to the north and west shall not be used as a balcony, roof garden or similar amenity area without the grant of further specific permission from the Local Planning Authority. Reason To prevent undue overlooking of adjoining property and ensure that the development accords with policy 7 of the adopted local plan 2021.
5.All building operations in connection with the construction of external walls, roof, and foundations; site excavation or other external site works; works involving the use of plant or machinery; the erection of scaffolding; the delivery of materials; the removal of materials and spoil from the site, and the playing of amplified music shall only take place between the hours of 8.00am and 6.00pm Monday to Friday, and between 8.00am and 1.00pm on Saturdays and not at all on Sundays and Bank Holidays/Public Holidays. Reason:- To protect residential amenity, and in order that the development accords with the Development Control Policies Development Plan Document Policy 33 (Air quality), 35 (On-site waste management) and 34 Managing pollution
6.Prior to commencement of the relevant works of the development hereby approved full details of doors and windows and samples of all materials including rainwater goods to be used in the construction of the roof extension hereby permitted are submitted to and approved in writing by the Local Planning Authority and thereafter the development shall be constructed with the approved details. Reason:- Insufficient information has been supplied with the application to judge the appropriateness of the doors, windows, materials and rainwater goods to be used. Submission of details prior to commencement will safeguard the appearance of the building and the character of the immediate area.
7.Prior to the first occupation of the development the details of the planter, the plant species and the maintenance programme shall be submitted to and approved in writing by the local planning authority. Thereafter, the scheme shall be implemented in accordance to the approved details prior to the first occupation of any dwellings and retained as such permanently thereafter. Reason:- Submission of details prior to commencement will ensure a satisfactory development in the visual interests of the immediate neighbours and that the development accords with Development Control Policies Development Plan Document Policy Policy 7.
8.No dwelling hereby approved shall be occupied until a full and detailed application for the Secured by Design award scheme is submitted to the Local Planning Authority, setting out how the principles and practices of the Secured by Design Scheme are to be incorporated. Once approved in writing by the Local Planning Authority in consultation with the Metropolitan Police Designing Out Crime Officers, the development shall be carried out in accordance with the agreed details. Reason:- Insufficient information has been supplied with the application to judge whether the proposals meet Secured by Design standards. Submission of a full and detailed application prior to commencement is in the interest of creating safer, sustainable communities and to reflect guidance in Policy 26 of the Local Plan (2016-2031) adopted 2021.
9.No building shall be occupied or use commenced until external lighting is provided in accordance with details previously submitted to and approved in writing by the Local Planning Authority. The lighting shall be provided and operated in strict accordance with the approved scheme. Reason:- Insufficient information has been supplied with the application to judge the impact arising from any external lighting required in connection with the building or use. Submission of this detail prior to occupation in the case of new building works or prior to the use commencing in the case of changes of use will protect residential amenity and ensure that the development accords with the Development Control Policies Development Plan Document Policy Policy 7.

11.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
12.The proposal is liable for the Mayor of London Community Infrastructure Levy (CIL). The Mayoral CIL levy rate for Havering is ????????£25 and is chargeable for each additional square metre of residential gross internal [floor] (GIA). Based upon the information supplied with the application, ????????£10,000.00 CIL would be payable due to result in a new residential property with 400sqm of GIA, however this may be adjusted subject to indexation. The proposal is also liable for Havering Council's CIL. Havering's CIL charging rate for residential is £125 for each additional square metre of GIA. Based upon the information supplied with the application £50,000 would be payable, subject to indexation. These charges are levied under s.206 of the Planning Act 2008. CIL is payable within 60 days of commencement of development. A Liability Notice will be sent to the applicant (or anyone else who has assumed liability) shortly and you are required to notify the Council of the commencement of the development before works begin. 13.Before occupation of the residential/ commercial unit(s) hereby approved, it is a requirement to have the property/properties officially Street Named and Numbered by our Street Naming and Numbering Team. Official Street Naming and Numbering will ensure that that Council has record of the property/properties so that future occupants can access our services. Registration will also ensure that emergency services, Land Registry and the Royal Mail have accurate address details. Proof of having officially gone through the Street Naming and Numbering process may also be required for the connection of utilities. 14.This planning permission does not remove the need to obtain any separate consent of the owner of the adjoining property prior to commencing building works on, under, above or immediately adjacent to their property (e.g. foundations or guttering). The Party Wall Etc. Act 1996 contains requirements to serve notice on adjoining owners of property under certain circumstances, and a procedure exists for resolving disputes. This is a matter of civil law between the two parties, and the Local Planning Authority are not involved in such matters. 15.Notwithstanding the drawing hereby approved, the scheme only relates to the formation of the flats over the roof the existing building and would not relate to any other part of the building.
16.the development is subject to legal agreement seeking to prevent the future occupiers of the site obtaining car parking permit within the Residential Control Parking Zone. The planning obligations secured in this planning permission have been subject to the statutory tests set out in Regulation 122 of the Community Infrastructure Levy Regulations 2010 and the obligations are considered to have satisfied the following criteria:- (a) Necessary to make the development acceptable in planning terms; (b) Directly related to the development; and (c) Fairly and reasonably related in scale and kind to the development.
