1.The proposal, by reason of the scale, bulk, mass and height of the proposed development and its relationship to neighbouring residential development, results in development that is out of scale and character with its surroundings, as well as visually intrusive and overbearing in relation to neighbouring dwellings, giving rise to loss of privacy and amenity, contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
2.The proposed development, by reason of the limited provision of external amenity space, and the relationship of the development with the adjacent service road and commercial uses, would give rise to a poor quality living environment, that is detrimental to the amenity of future occupiers of the proposed development, and contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
3.The proposed development, due to its height, proximity to eastern boundary and positioning of windows, would prejudice the satisfactory development of the adjoining site to the east/northeast (land to rear of 7-22 Broadway Parade) contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In determining this application the Local Planning Authority has worked positively and proactively with the applicant by assessing the proposals against relevant Development Plan policies, all material considerations, consultation responses and any valid representations that may have been received, identifying issues of concern and entering into discussion with the applicant to explore the possibility of suitably resolving such matters. This approach has been in accordance with the requirement set out in the National Planning Policy Framework. Although revised plans have been received, which have reduced the number of units and reduced some elements of the bulk of the building, it is not considered that the revisions made are sufficient to overcome the Local Authority's concerns regarding the application. Therefore, in this instance, it has not been possible to resolve the issues of concern, within the determination period, so as to overcome the harm as identified in the reason(s) for refusal. The Local Planning Authority has set out within its report the steps considered necessary to overcome the identified harm, where and if appropriate, which may lead to the submission of a more acceptable scheme in the future. The Local Planning Authority also offers a pre-application advice service that can be used to obtain advice in respect of any revised proposal.
