1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The proposed development hereby approved shall be constructed in accordance with the materials detailed under materials section of the application form unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the appearance of the proposed development will harmonise with the character of the surrounding area.
4.In accordance with the details on the approved plan number GD-ARCH-NDU-PL23 REV B and prior to the first use of the outbuilding and decking hereby approved, a 2m high close boarded fence shall be erected adjacent to the proposed outbuilding and decking along the shared boundary with No.5 Garland Way, Hornchurch. The fencing shall be permanently retained and maintained thereafter. Reason:- To protect the visual amenities of the development and prevent undue overlooking of adjoining property.
5.The proposed flank window to the wet room as shown on Side (1) Elevation on drawing GD-ARCH-NDU-PL23 REV B shall be permanently glazed with obscure glass not less than level 4 on the standard scale of obscurity and shall thereafter be maintained and permanently fixed shut. Reason:- In the interests of privacy.
6.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 the outbuilding to be used for a music/entertainment room hereby permitted shall be used only for purposes incidental to the enjoyment of the dwelling house and not for any trade or business nor as living accommodation. Reason:- To restrict the use to one compatible with a residential area.
7.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no window or other opening (other than those shown on the submitted and approved plan,) shall be formed in the flank or rear wall(s) of the building(s) hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority. Reason:- In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future.
8.The hard surface hereby approved (including any sub-base) shall be made of porous materials or provision shall be made to direct run-off water from the hard surface to a permeable or porous area or surface within the curtilage of the dwellinghouse. Reason:- In order to ensure no water run-off from the hard surface which would contribute to risk of flooding
9.Patio, Decking or Raised Platform Informative The applicant should note that putting up decking, or other raised platforms, in your garden is permitted development, not needing an application for planning permission, providing: ·The decking is no more than 30cm above the ground ·Together with other extensions, outbuildings etc, the decking or platforms cover no more than 50 per cent of the garden area. ·None of the decking or platform is on land forward of a wall forming the principal elevation.
10.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with Ms Nichole Avan-Nomayo (Agent) by e-mail. A 2m high close boarded fence is now proposed adjacent to No.5 Garland Way, Hornchurch along the boundary with the outbuilding and decking as shown on the revised plan. The amendments were subsequently submitted on 02.02.23.
